The protection of your privacy is of the utmost importance to Alfred Technologies inc. (hereinafter ALFRED). This Privacy Policy applies to how we collect, use, disclose, transfer and store your data. Collection and use of personal data
Personal data (or « personal information ») is data that can be used to uniquely identify or contact a single individual. You may be asked to provide your personal data at any time when you are in contact with ALFRED or an ALFRED affiliate. ALFRED and its affiliates may share this personal information with each other and use it in accordance with this Privacy Policy. They may also combine it with other information to provide and improve their products, services, content and advertising.
What personal data do we collect
When you apply to create an ALFRED ID (« ALFRED ID »), register your products and preferences, purchase a product, download a software update, or participate in an online survey, we may collect a variety of information, including your name, mailing address, phone number, email address, and contact preferences.
How do we use your personal data?
The personal data we collect allows us to keep you informed of the latest product announcements, software updates and upcoming ALFRED events. By knowing your preferences, it also allows us to improve our services, content and advertising. If you do not wish to be on our mailing list, you can unsubscribe at any time by contacting us.
We may periodically use your personal information to send important notices, such as communications about purchases and changes to our license terms and conditions. Because this information is important to your relationship with ALFRED, you may not opt out of receiving these communications.
We may also use personal data for internal purposes, such as audits, data analysis and research to improve ALFRED’s products, services and customer communications.
Collection and use of non-personal data
We also collect non-personal data (data that cannot be directly linked to a specific individual). We may collect, use, transfer and disclose non-personal data for any purpose.
We may collect information such as the occupation, language, zip code, area code, location, and time zone in which an ALFRED product is used in order for us to better understand our customers’ behavior on a general basis, and to improve our products, services, and advertising.
We may also collect information about customer activities through our website, and from our other products and services. This data is collected and used to help us provide more useful information to our customers and to understand which parts of our site, products and services are most popular. The data collected is considered non-personal data for the purposes of this Privacy Policy.
If we combine non-personal data with personal data, the combined data will be treated as personal data for as long as it remains combined.
Cookies and other technologies
ALFRED’s website, online services, interactive applications, emails and advertisements may use « cookies » and other technologies, such as web beacons or « pixel tags. These technologies allow us to better understand user behavior, tell us which parts of our site and applications are most visited, and facilitate and measure the effectiveness of Internet advertising and searches. We treat the data collected by cookies and other technologies as non-personal data. However, to the extent that Internet Protocol (IP) addresses or similar identifiers are considered personal data by local law, we will also treat these identifiers as personal data. Similarly, to the extent that non-personal data is combined with personal data, we will treat the combined information as personal data for the purposes of this Privacy Policy.
ALFRED and its partners use cookies and other technologies in the advertising services to track the number of times you view a given advertisement, to deliver advertisements that are relevant to your interests, and to measure the effectiveness of advertising campaigns. If you do not wish to receive ads at this level of relevance, please contact us. If you opt-out, you will continue to receive the same number of ads, but they may be less relevant because they are not related to your interests. You may still see ads related to the content of a web page or application or based on other non-personal information. This opt-out applies only to ALFRED advertising services and does not affect interest-based ads from other advertising networks.
ALFRED and its partners also use cookies and other technologies to remember your personal information when you use our site, online services and applications. In this case, our goal is to make your visit more convenient and personalized. For example, knowing your first name will allow us to welcome you the next time you visit ALFRED. Knowing your contact information, product serial numbers, and information about your computer or device helps us register your products, customize your operating system, set up your Virtual Sommelier service, and provide you with better customer service.
If you are using the Safari web browser and wish to disable cookies, go to the Safari preferences, then to the Privacy pane where there is an option to do so. On your ALFRED mobile device, go to Settings, then Safari, then the Cookies section. For other browsers, please check with your provider to find out how to disable cookies. Please note that some features of the ALFRED website (as well as those of many other websites) will no longer be available once cookies are disabled.
Like many websites, we collect certain information automatically and store it in log files. This data includes Internet Protocol (IP) addresses, browser type and language, Internet Service Provider (ISP), referring and exit pages, operating system, date/time stamp, and data about your visit to the site.
We use this data to understand and analyze trends, administer the site, track user behavior on the site, and gather demographic information about our users as a whole. ALFRED and its partners may use this information for their marketing and advertising services.
In some of our emails, we use a « click-through URL » to the content of the ALFRED website. When customers click on one of these URLs, they are transferred to another web server before arriving at the landing page of our site. We track these clicks to help us determine interest in certain topics and measure the effectiveness of our customer communications. If we prefer not to be tracked in this way, you should not click on any text or graphic links in the emails.
Pixel tags allow us to send e-mail messages in a format that customers can read and to track whether the message has been opened. We may use this information to reduce or delete messages sent to customers.
Disclosure to partners
ALFRED may provide its retail partners with suggested product offerings to you or data that may assist them in their business relationship with you.
These suggested product purchases are based on your taste and interest profile and on the analysis of your wine cellar profile.
Suggestions for purchases are sent to our retail partners in a format that does not allow for a detailed inventory of your wine cellar.
Privacy of wine cellar data
ALFRED acknowledges that its customers may transmit information in any format concerning their wine cellar (including, but not limited to, its contents and storage locations)
ALFRED agrees that such information may contain confidential information, which is defined as any information disclosed in any way by its customers or their employees or agents to ALFRED or its affiliates, employees, directors, officers, agents or other representatives.
Confidential information includes both information provided by its customers for the purposes of ALFRED’s computer applications and any other information about its customers that may be obtained by ALFRED and its employees or agents. Notwithstanding the foregoing, Confidential Information excludes any information : (i) that was in the public domain prior to its disclosure; or (ii) that has become public domain without any breach of confidentiality obligation by ALFRED.
ALFRED agrees to keep its customers’ confidential information in the strictest confidence, not to disclose it to third parties including its retail partners, and not to reproduce or use it without the customer’s written permission. ALFRED undertakes to disclose confidential client information only to those of its employees, directors, officers, agents or other representatives for whom the knowledge is necessary, who shall in all cases be bound by obligations of confidentiality at least as strict.
In the event that a disclosure of confidential information is requested by one of its business partners, ALFRED undertakes to notify its clients in writing, and will respect the written instructions of any client who refuses to have his or her confidential information disclosed.
Any information disclosed will be considered confidential whether or not it is marked « confidential » or whether or not the recipient is notified orally that the information is confidential, provided that it is reasonable for the recipient to assume, having regard to the circumstances surrounding the disclosure or the type of information in question, that the information is confidential. In case of doubt, ALFRED may ask its client to determine in writing whether any specific information or document should be treated as confidential or not.
At any time at the request of a customer, ALFRED undertakes to deliver to its customer any documentation, in any format whatsoever, received from the customer, as well as any copy that ALFRED may have made.
Other provisions
ALFRED may be required – by law, in connection with legal proceedings, litigation and/or a request from public authorities in your country of residence or otherwise – to disclose your personal data. We may also disclose your data if we believe that for national security, law enforcement or other public interest purposes, disclosure is necessary or appropriate.
We may also disclose information about you if we believe that disclosure is reasonably necessary to enforce compliance with our terms and conditions or to protect our business or our users. In addition, in the event of a reorganization, merger or sale, we may transfer any personal information we collect to the relevant third party (who must, of course, agree to the same confidentiality commitments as ALFRED).
To the extent that Personal Information is required to be disclosed by law or by order of a judicial or administrative authority, ALFRED will send written notice to the customer so that the customer may obtain a protective order or other appropriate remedy, if necessary. Such notice will be given to the customer as soon as possible, but ALFRED cannot guarantee that in every case time will permit the customer to request such orders. Also, there may be instances where ALFRED is prohibited by law from providing this notice.
Protection of personal data
ALFRED takes precautions – including administrative, technical and physical measures – to protect your personal data against loss, theft and misuse, as well as unauthorized access, disclosure, alteration and destruction.
ALFRED online services, such as the Virtual Sommelier, use Secure Sockets Layer (SSL) encryption on all web pages where personal data is collected.
When you use certain ALFRED products, services or applications or participate in an ALFRED forum, chat or social networking service, the personal data you share is visible to other users who may read, collect and use it. You are responsible for the personal data you choose to submit in these circumstances. For example, if you post your name and email address on a forum, this information will be public. You must be careful when using these features.
Integrity and retention of personal data
Subject to the exclusions and limitations set forth in the license agreement and the terms of use of our services, ALFRED allows you to maintain the accuracy, currency and integrity of your personal data easily. We will retain your personal data for as long as necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.
Access to personal data
You can ensure that your contact information and preferences are accurate, complete and up-to-date by contacting us. With respect to other personal data, we make a good faith effort to provide you with access to request that we correct the data if it is inaccurate or delete it if ALFRED is not required to retain it by law or for legitimate business purposes. We may refuse to process requests that are unreasonably repetitive, require disproportionate technical effort, jeopardize the privacy of third parties, or requests that are extremely difficult to implement or for which access is not otherwise required by applicable law. Minors
We do not knowingly collect personal data from minors under the age of 18. If we become aware that we have collected personal data from a minor under the age of 18, we will take steps to delete that information as soon as possible.
Geolocation services
To provide location-based services on ALFRED products, ALFRED and its partners and licensees may collect, use and share precise location data, including the real-time geographic location of your computer or mobile device. This location data is collected anonymously in a non-personally identifiable format and is used by ALFRED and its partners and licensees to provide and improve location-based products and services. For example, we may share geographic location with application providers if you accept their location services.
Third-party sites and services
ALFRED’s websites, products, applications and services may contain links to third-party websites, products and services. Our products and services may also use or offer third party products or services. Information collected by third parties, which may include items such as location data or contact information, is governed by their privacy policies. We invite you to read the privacy policies of these third parties.
